Terms of Service

These terms govern your use of the Alphynex service, provided by ALPHYNEX LLC, a Wyoming limited liability company (“Alphynex”, “we”, “us”). By subscribing or using the service, you agree to these terms on behalf of yourself and the business you represent (“you”).
1. The service
Alphynex is a business-to-business data subscription for recruiting agencies. Each week we send you a list of up to 15 leads about US companies that show signs of struggling to fill a role. Each lead may include the company, its website, the role, the location, the signal we detected and its evidence, a link to the public job posting, a hiring contact’s name, title and business email, and the date your exclusivity on the lead ends. Lists are delivered by email as a spreadsheet.
2. Subscription, billing and renewal
The subscription costs $299 per month, plus any applicable taxes. Payments are processed by Stripe. Your subscription renews automatically every month, and you authorize us to charge your payment method at the start of each monthly period until you cancel. We may change the price with at least 30 days’ notice by email; the new price applies from your next renewal after the notice period.
3. Cancellation
You can cancel at any time using the link in any weekly email or by writing to sam@alphynexhq.com. Cancellation takes effect at the end of the monthly period you have already paid for. You keep receiving lists until then, and you will not be charged again. Refunds are covered by our Refund policy.
4. Exclusivity
When a lead is delivered to you, we will not deliver the same company to another agency for 30 days from delivery. The exclusive-until date is shown on each lead. Exclusivity applies to our own deliveries only: the companies’ job postings are public, and other agencies may find them independently. We provide exclusivity on a best-effort basis.
5. Acceptable use
- You must comply with the CAN-SPAM Act and all other applicable anti-spam, privacy and marketing laws when you contact anyone named in the leads, including honoring opt-out requests promptly.
- The data is licensed to you for your own agency’s business development. You may not resell, sublicense, publish or share the data with third parties, or use it to build a competing data product.
- You may not use the data to harass anyone or for any unlawful purpose.
We may suspend or end your access if you breach this section.
6. No guarantee of results
We provide information about hiring activity. We do not guarantee that any company will work with you, that any contact will respond, or that you will make any placement or hire.
7. Data provided “as is”
Leads are compiled from public job postings and third-party business contact data providers. Job postings change and contact details go out of date. The data is provided “as is” and “as available”, without warranties of any kind, express or implied, including accuracy, completeness, merchantability or fitness for a particular purpose.
8. Limitation of liability
To the fullest extent permitted by law, Alphynex will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or business opportunities. Our total liability for any claim relating to the service is limited to the fees you paid us in the three months before the event giving rise to the claim.
9. Changes to these terms
We may update these terms. If a change is material, we will email you at least 14 days before it takes effect. Continuing to use the service after that date means you accept the updated terms.
10. Governing law
These terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Wyoming.
